The paper discusses the problem of the relationship between ethics and truth starting from a critique of the contemporary paradigm of post-truth. The opposition between objectivity and subjectivism that is the basis of this paradigm is questioned by inserting the medium term of objectivity as fairness. The truth is thus recovered as an exceding dimension that can never be completely owned. This paper explores Husserl’s late manuscripts in order to sketch a phenomenological description of drives and the dimension of passive constitution that belongs to them. Although this topic touches upon psychological issues, it will be shown that a specifically phenomenological approach allows us to recognize the transcendental significance of instincts. Phenomenology and psychology are two fundamental disciplines of culture in the 20th century. The phenomenology of Husserl was assimilated by Sartre at the beginning of the century, until the publication of L’être et le néant (1943).
